En el orden sucesorio ab intestato el llamamiento que se hace a la mujer en su condición de cónyuge supérstite viuda, ha tenido siempre una evolución progresiva favorable hacia una mejora en la posición de llamada. Desde el lugar que ocupaba en los primeros tiempos del ius civile romano hasta el reconocimiento y lugar de su derecho en la actualidad, siempre ha ido escalando puestos sin solución de continuidad. Por cierto, el llamamiento a la mujer siempre ha evolucionado a la par que la del hombre, ni mejor ni peor, viudo/viuda, siempre han sido mencionados conjuntamente bajo el apelativo singular de cónyuge supérstite (unde vir et uxor).
