En este trabajo, el objeto de comparación será la obligación de contribuir a los gastos comunitarios en la propiedad horizontal y las consecuencias derivadas de su incumplimiento. Ésta debe ser considerada como la más importante que ostentan los condueños en el régimen de la propiedad horizontal, de hecho, resulta una obligación esencial. Mediante el estudio de la cuestión en los ordenamientos jurídicos español y portugués, se podrán concluir propuestas de mejora de estos, siendo éste el objetivo final del presente artículo. La obligación de contribuir en ambos ordenamientos comparte una misma naturaleza jurídica. Es importante comprender la configuración de los distintos elementos de la propiedad horizontal, así como la contribución a su conservación e innovación. Resulta esencial el criterio de distribución del gasto, así como la delimitación temporal de la obligación de contribuir de los condóminos. El completo análisis de una obligación jurídica debe contener también las consecuencias de su incumplimiento. La conclusión final es el análisis conjunto de ambos ordenamientos aporta elementos de mejora recíproca de ambos, y aporta soluciones que podrían enriquecerlos, que se detallan en el último epígrafe de este artículo.
