San Martín Calvo, Marina 2015-03 Tras la apertura del Mercado Único Europeo, en 1992, se hizo necesario articular un sistema que permitiera a los Estados miembros proteger la integridad de su patrimonio cultural, amenazado por la supresión de las fronteras interiores, sin desvirtuar el espíritu librecambista que impregna el Tratado de Maastrich y respetando, en todo caso, el principio de subsidiariedad que rige la normativa comunitaria. El presente artículo estudia los instrumentos legales adoptados por la Unión Europea dirigidos a impedir la exportación de bienes culturales hacia países extracomunitarios, facilitando la restitución de aquellos que hubieran abandonado ilícitamente el territorio de un Estado miembro.
