gran arraigo y difusión en el tráfico mercantil; posteriormente, mediante&#xd;
el fenómeno de la recepción, ha llegado hasta el derecho moderno, si bien&#xd;
nunca ha sido contemplado en un cuerpo legal. Sin embargo, es utilizado&#xd;
de forma muy habitual en el comercio minorista, regulado, fundamentalmente, por la opinión doctrinal y jurisprudencial. Actualmente existe una&#xd;
propuesta de Anteproyecto de Ley de Código mercantil, elaborada por la&#xd;
Comisión General de Codificación, Sección Segunda de Derecho mercantil,&#xd;
que si culmina con éxito su periplo legislativo, el contrato estimatorio quedará regulado por primera vez en nuestro ordenamiento jurídico. Y será un&#xd;
contrato tipificado en la categoría de «los contratos de colaboración», los&#xd;
cuales sirven de cauce a la cooperación entre empresarios que desarrollan&#xd;
actividades complementarias. De producirse este hecho tan transcendental,&#xd;
quedará demostrado, una vez más, que todas aquellas cuestiones jurídicas&#xd;
a las que el ordenamiento jurídico romano no alcanzó a dotar de una solución legal certera y definitiva, han llegado con las mismas dudas hasta&#xd;
nuestros días.</dim:field>
<dim:field mdschema="dc" element="description" qualifier="abstract" lang="en">The consignment agreement emerged in Rome where its&#xd;
acceptance and use among travelling merchants was widespread; subsequently,&#xd;
through the process of reception of law, it has entered into modern law, although it has never been contemplated in a legal text. However, it is widely used&#xd;
in retail commerce, regulated, fundamentally, by doctrinal and jurisprudential&#xd;
opinion. At present, there is a preliminary draft law for the enactment of a&#xd;
Commercial Code, prepared by the General Legislation Commission, Second&#xd;
Section of Commercial Law, which, if successful in its legislative journey, will&#xd;
for the first time regulate the consignment agreement in the Spanish legal order.&#xd;
And the contract will be defined under the category of «contracts of collaboration», which serve as a channel for cooperation between entrepreneurs who&#xd;
develop complementary activities. If such a transcendental law were enacted,&#xd;
it would once again be demonstrated that all those legal questions to which the&#xd;
Roman legal order never managed to arrive at a certain and definitive legal&#xd;
solution, have with the same doubts been passed down to our day and age.</dim:field>
