Algunas tensiones territoriales en la asistencia sanitaria a los inmigrantes en situación administrativa irregular

El Decreto-ley 16/2012, de 20 de abril, ha modificado la legislación en materia de
extranjería y sanidad. Una de las medidas que adopta es la limitación de la asistencia
sanitaria y la privación de la tarjeta sanitaria a los inmigrantes en situación irregular.
En el trabajo se analiza la utilización del Decreto-ley como norma no idónea para limitar
el derecho a la salud. También se examina la diferente reacción de las Comunidades
Autónomas ante la reforma introducida por el Decreto-ley 16/2012 y la posible invasión
de la legislación básica estatal por determinas normas autonómicas que amplían
las prestaciones sanitarias y la titularidad del derecho a los inmigrantes irregulares
The Law 16/2012, of April 20, has changed the legislation on immigration and health
care in Spain. One of the measures adopted is the limitation of health care and the
denial of health insurance cards to undocumented immigrants. In this text the
author analyses the application of the Law as an inadequate measure for limiting
the right to health. Furthermore the author examines the different reactions of
the Autonomous Communities to the reform and the possible invasion of the basic
state legislation through regional rules which expanded the health care services to
irregular immigrants.
