Fue criticado porque dejaba fuera de su marco de protección a los artistas que hubieran consentido que su prestación se incorporara a un soporte audiovisual. En 1996 se aprobó un nuevo Tratado para conseguir actualizar el anterior teniendo en cuenta la tecnología digital. El nuevo instrumento insistió en dejar fuera a los artistas intérpretes o ejecutantes del medio audiovisual. Para subsanar esta laguna en 2011 por fin se adoptó en Beijing el Tratado sobre Interpretaciones y Ejecuciones audiovisuales. Este convenio establece una protección para los artistas del medio audiovisual con el mismo contenido y extensión que lo hacía el Tratado de 1996 para los artistas del medio sonoro. Con ello algunos aspectos que habían suscitado recelos o dudas siguen presentes. No está muy claro el objeto sobre el que recaen los derechos de los artistas intérpretes o ejecutantes al incluir en su definición la interpretación que puedan hacer de expresiones del folklore. Se mantiene la cláusula de salvaguardia de los derechos de los autores. Y también se mantiene una duración mínima por debajo de la protección que reciben los autores de las obras interpretadas. In 1961, with the passing of The Rome Convention an International Treaty on performers, producers of phonograms and broadcasting organisations was adopted for the first time. It was harshly criticised for it leaved outside its legal frame artists having given consent to their live performance being fixated, broadcasted, reproduced or communicated. In 1996 with a view to update the previous Treaty in addition to having into account digital technology, a new one was passed. This new legal instrument persisted in leaving legally unprotected performers, producers of phonograms and broadcasting organisations. At last, in 2011 in order to amend this loophole, the Beijing Treaty on the protection of Audiovisual Performances was adopted. This treaty gave audiovisual performers a similar protection in content and extent to that one provided by the 1996 Treaty to the phonogram performers. Yet, some misgiving and doubt generating aspects remain still unclear for the definitions of performers, producers of phonograms and broadcasting organisations include their folkloric expressions.
