En este artículo se contiene un análisis detallado de los supuestos de llamamientos
preferentes que irrumpen en el orden sucesorio general ab intestato entre los parientes
colaterales, incluido el cónyuge supérstite, y el Estado (fiscus) como ultimus heres. Se trata
de llamamientos excepcionales que no conllevan que el Estado desaparezca del orden
sucesorio intestado.
In this paper, a detailed analysis is set out of the circumstances of favored heirs that arise in the general intestate order of succession between collateral relatives, including the surviving spouse, and the State (fiscus) as the final heirs (ultimus heres). It is a matter of exceptional eligibility that in no way, however, implies that the State disappears from the intestate order of succession.
