El Derecho a la reunificación familiar en la Unión Europea y en España desde una perspectiva legal y jurisprudencia

Abstract

El derecho a la vida en familia constituye uno de los pilares de la sociedad. De ahí la importancia del reconocimiento del derecho a la reagrupación familiar que, en la Unión Europea, lugar de destino de importantes flujos migratorios, adquiere una especial dimensión, especialmente marcada por los frecuentes conflictos suscitados entre los Estados miembros y la normativa europea. Estas diferencias han dado lugar a una ingente cantidad de procedimientos judiciales resueltos, a través de cuestiones prejudiciales, por el Tribunal de Justicia de la Unión Europea, que ha ido perfilando los contornos jurídicos de este controvertido derecho fundamental.
